1. Who we are and acceptance of these Terms

3Social (“3Social,” “we,” “us,” or the “platform”) is the creator-social platform available at 3social.io and www.3social.io. At the time of this update, 3Social is operated as an independent project. By accessing or using 3Social, connecting a wallet, publishing content, joining a live experience, depositing funds, or using MintScale-powered features, you agree to these Terms and our Privacy Policy.

2. Eligibility and authority

3Social is a general-audience service and is not directed to children under 13. You must be legally able to enter into these Terms where you live. If you use 3Social for an organization or another person, you represent that you are authorized to bind them. You may not use a wallet, payment feature, or digital asset that you are not legally authorized to control.

3. What 3Social is

3Social supports publishing, discovery, profiles, forums, direct messages, collaborations, groups, short-form MintVid videos, LivMint live experiences, creator programs, content provenance, and creator monetization. MintScale is 3Social’s metering and settlement system. Supported interactions can carry creator-defined prices, and supported derivative content can preserve attribution to upstream creators.

Production settlement currently uses native USDC on Base. Features, networks, assets, rates, limits, eligibility, and availability can change. The price, preview, cap, recording-retention, audience, revenue-split, and settlement information shown in the product for a particular interaction controls over examples or defaults in these Terms.

4. Wallet access and account security

3Social uses wallet-based authentication, including Sign-In With Ethereum (SIWE) for supported externally owned and smart-contract wallets. A wallet address can be associated with a username, profile, content, social activity, pricing settings, payout settings, and settlement history. 3Social does not need your private key or seed phrase and will never ask you to provide either.

You are responsible for your wallet, device, keys, recovery phrase, signatures, and actions authorized by a wallet you control. Blockchain transactions and signatures can be irreversible, and loss or compromise of a wallet can cause loss of access or funds. Contact support promptly if you believe your 3Social session or account has been compromised.

5. MintScale pricing, deposits, charges, and settlement

Creator-controlled pricing. Creators can configure supported prices for likes, comments, reposts, follows, bookmarks, remixes, time-based viewing, and streaming, together with previews and caps. Content-specific pricing can override a creator default, which can override a platform default.
Activation and publishing charges. Some creator or publishing features may require a minimum escrow balance, activation amount, posting charge, storage reserve, or streaming reserve. Any amount and refundability will be shown in the product before authorization.
USDC escrow on Base. To use paid interactions, you may deposit USDC into the MintScale escrow smart contract. Deposited but unused escrow remains associated with the depositing wallet and can be withdrawn through supported contract controls, subject to blockchain conditions and network fees.
Metered charges. By initiating or continuing a priced interaction after applicable price and preview information is presented, you authorize charge records under the displayed policy and settlement from available escrow.
Policy snapshots. A metering session records the applicable pricing-policy version, so later pricing changes do not retroactively change an already-created charge.
Default platform split. The current default is 85% of a standard charge to the creator side and 15% to 3Social. An approved creator policy may differ. Smart-contract and settlement records are authoritative for completed allocations.
Derivatives and cosigned comments. Creator-side proceeds can be allocated among downstream, upstream, post, or comment creators under the displayed attribution policy. The current default for a qualifying cosigned comment is 70%/30% of the creator-side share between the original post creator and comment author.
Payout wallets. Creator payouts may require a payout address verified by wallet signature. Amounts may remain pending or payout-blocked until required information is valid and verified.
Finality. Confirmed on-chain charges, withdrawals, and distributions generally cannot be reversed by 3Social. A completed charge is not a discretionary refundable purchase.
You are responsible for wallet or network fees and for taxes arising from amounts you pay, receive, or withdraw. 3Social does not provide tax advice.

6. Content, media, provenance, and licenses

You retain ownership of content you create and post. You grant 3Social a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, format, adapt for technical delivery, and distribute that content as reasonably necessary to operate, secure, improve, and promote the platform and provide features you request. This license ends when the content is no longer needed for those purposes, except for backups and retained legal, moderation, provenance, and settlement records.

You must have all rights and permissions needed for text, images, audio, video, music, likenesses, trademarks, and other material you upload, livestream, remix, quote, monetize, or instruct an AI tool or agent to publish. 3Social may compute file and content hashes, preserve caption revisions, and register hashes, timestamps, ledger identifiers, or derivative relationships on a public blockchain. These records are evidence generated by the platform, not copyright registration or a guarantee of legal ownership.

Archiving or changing visibility can remove eligible content from discovery without ending existing economics or provenance. Deleting or revoking content hides it from supported public surfaces while required records may remain. Under current product rules, a deleted or revoked upstream post forfeits future upstream royalties from downstream remixes; completed settlements remain unchanged.

7. MintVid and LivMint

MintVid allows supported short-form video capture and upload. If you record in the browser, you choose whether to grant camera and microphone permission. Uploaded media becomes content subject to these Terms, may be hashed and queued for provenance registration, and may carry the publishing price shown before submission.

LivMint uses third-party streaming infrastructure. Hosts may be required to reserve funds for estimated streaming and recording delivery. Viewers may incur time-based charges after any free preview and subject to displayed caps. A host who requests recording authorizes 3Social and its providers to capture, process, store, and make the replay available under the selected audience and product settings. The retention period shown for the room or feature applies; operational copies, minted replays, provenance, moderation, and legal records may remain longer where necessary.

Livestreams can be recorded or redistributed by participants or third parties outside 3Social’s control. Do not stream confidential material, and obtain consent from people who appear or can be heard where required.

8. Social, messaging, collaboration, and groups

3Social may provide feeds, profiles, follows, comments, mentions, notifications, profile-wall posts, direct messages, collaboration invitations, forums, groups, search, discovery, live rooms, reposts, and remixes. You are responsible for communications and invitations you send. Do not put private keys, recovery phrases, financial credentials, or highly sensitive information in messages or private surfaces.

Where enabled, public/private profiles, approved followers, blocking, and group membership control application-level access. Blocking overrides direct interaction and existing relationship access within supported surfaces. Group owners, admins, and moderators may set visibility and join policy, manage membership and roles, moderate posts, ban members, and transfer ownership. These controls do not make public blockchain activity private.

9. Creator programs, referrals, and promotions

Applications for creator, founding-creator, referral, reward, or promotional programs may require eligibility evidence such as an external publishing profile, audience metrics, recent activity, ownership proof, or acceptance of additional terms. You must provide accurate information and authorize reasonable verification of submitted public evidence.

Program approval, activation, rewards, boosted economics, and availability are not guaranteed. We may reject, pause, modify, or end a program or remove a participant for ineligibility, inaccurate claims, abuse, legal risk, or violation of these Terms, subject to any separate written terms that apply.

10. Automated access and AI-assisted publishing

Public pages may be accessed by search engines, crawlers, and AI systems subject to our published crawler instructions and applicable law. Those instructions are not a security boundary and do not grant rights beyond these Terms. You may use AI tools to help create content, but you remain responsible for its accuracy, legality, rights clearance, labeling, and compliance.

Do not use bots, scripts, agents, scraping, or automation to bypass access controls or rate limits; collect non-public information; impersonate people; spam; manipulate ranking or rewards; manufacture paid engagement; or initiate wallet signatures, deposits, charges, withdrawals, or payouts without the wallet controller’s informed authorization. Automated publishing or account access is permitted only through features or interfaces 3Social expressly makes available for that purpose.

11. Acceptable use and anti-abuse

You may not use 3Social to:

violate law or another person’s privacy, publicity, intellectual-property, or contractual rights;
publish unlawful threats, targeted harassment, non-consensual intimate material, sexual exploitation material, or content that facilitates serious harm;
phish, distribute malware, compromise wallets or accounts, evade sanctions, launder funds, or facilitate fraud;
manipulate engagement, provenance, metering, referral, reward, creator-program, payout, or settlement systems;
circumvent blocks, privacy settings, bans, group restrictions, technical safeguards, or administrative controls; or
interfere with, overload, reverse engineer contrary to law, or probe the service without authorization.

12. Moderation and enforcement

We may investigate reports, limit distribution or monetization, remove content from application surfaces, restrict features, suspend or ban accounts, preserve evidence, or refer matters to authorities when reasonably necessary for safety, security, legal compliance, settlement integrity, or enforcement. Moderation does not guarantee that all harmful content will be found. Blockchain records and completed transactions may remain even when application content is removed.

Copyright concerns may be sent to legal@3social.io with identification of the work, the material, contact information, a good-faith statement, and evidence of authority. This contact process does not represent that 3Social has designated a DMCA agent or qualifies for a statutory safe harbor.

13. No investment, custody, banking, or earnings guarantee

3Social is not a bank, broker, exchange, investment adviser, fiduciary, or tax adviser. USDC and blockchain features involve smart-contract, wallet, network, liquidity, issuer, regulatory, operational, and market risks. Creator revenue, audience growth, discoverability, program acceptance, and payouts are not guaranteed.

14. Third-party services

3Social depends on wallets, Base and other blockchain infrastructure, USDC, RPC/node providers, hosting and database providers, object storage, Amazon Interactive Video Service and related AWS services, link-preview destinations, and other third-party systems. Their terms and privacy practices may apply. We are not responsible for failures or changes outside our reasonable control.

15. Disclaimers and limitation of liability

To the maximum extent permitted by law, 3Social is provided “as is” and “as available,” without warranties of uninterrupted operation, accuracy, availability, fitness for a particular purpose, non-infringement, or error-free smart contracts or third-party services. To the maximum extent permitted by law, 3Social and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, data, goodwill, content, digital assets, or opportunities arising from use of the platform. Rights that cannot lawfully be waived remain unaffected.

16. Changes and termination

We may change features and these Terms as the platform develops. Material revisions will be reflected by the “Last updated” date and, where appropriate, additional notice. Continued use after revised Terms take effect constitutes acceptance where permitted by law. You may stop using 3Social at any time, but blockchain transactions, completed charges, and records retained for legal, security, provenance, moderation, or settlement purposes may remain.

17. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except where mandatory consumer law requires otherwise.
